The Swipe Fee Lawsuit: What It Means for Your Business

 
 

In 2005, many store owners and trade groups in the United States felt that big credit card companies like Visa and Mastercard, along with several banks, were being unfair by setting high fees whenever customers used credit or debit cards. These fees, often called "swipe fees," are charges that stores have to pay every time someone buys something with a card. The store owners believed these companies were working together to keep these fees high, which they thought was unfair and against the law.

To address this, the store owners took the companies to court in a big group lawsuit. After many years of discussions and legal proceedings, in 2019, a judge approved a settlement where Visa, Mastercard, and the banks agreed to pay over $5 billion to the affected stores. This was one of the largest settlements of its kind in U.S. history.

By December 2023, forms were sent out to many business owners who had accepted Visa or Mastercard payments between 2004 and 2019, informing them about the settlement and how they could claim their share of the money. The deadline to submit these claims was extended to February 4, 2025.

Even after this settlement, there were more legal actions. In September 2024, the U.S. Department of Justice filed a lawsuit against Visa, accusing the company of unfair practices in the debit card market. Additionally, in March 2024, another agreement was reached to lower the swipe fees for stores, aiming to save retailers about $30 billion over five years.

This long legal journey highlights the challenges and efforts to make the payment system fairer for businesses and consumers alike.
